General Terms and Conditions

Section 1 Scope of the Terms and Conditions / Type of contractual relationships
(1) These General Terms and Conditions (hereinafter: “GTC”) govern the use of the website (“www.acasa4you.de”) operated by Genobilia eG, Ulmenweg 5, 53949 Dahlem (hereinafter: “Genobilia”), bookings of accommodations advertised via this website, and the accommodation contract relationship between the person making the booking and Genobilia (Section 1 no. 2 a) of these GTC) or the accommodation contract relationship between the person making the booking and a third-party provider (hereinafter also: “Host”) (Section 1 no. 2 b) of these GTC). The third-party provider agrees to this. However, the third-party provider remains entitled, with regard to the accommodation contract relationship between it and the person making the booking, to refer additionally to or in replacement of its own general terms and conditions. Such general terms and conditions do not affect the relationship between Genobilia and the third-party provider.
(2) Bookings on the website relate either to
a) accommodations of Genobilia (hereinafter also: “own properties”) or
b) accommodations (hereinafter also: “third-party properties”) of third-party providers
a) accommodations of Genobilia (hereinafter also: “own properties”) or
b) accommodations (hereinafter also: “third-party properties”) of third-party providers
(3) When booking own properties under Section 1 no. 2 a) of these GTC, Genobilia is the host. The accommodation contract is concluded between the person making the booking and Genobilia.
(4) When booking third-party properties under Section 1 no. 2 b) of these GTC, the Host is the host. The accommodation contract is concluded between the person making the booking and the Host. In this case, Genobilia acts as an intermediary. Genobilia provides the website, advertises accommodations, arranges bookings, and may provide payment services. Genobilia does not become a party to the accommodation contract between the person making the booking and the Host and is not liable for the Host’s breach of performance obligations towards the person making the booking. The Host authorizes Genobilia to collect payments in its own name for the Host’s account.
(5) Genobilia and the Host are not tour operators; no package tours or linked travel services are offered.
Section 2 Information provided during registration and booking / Review by Genobilia / Blocking
(1) Registrations (creating an account) and bookings are only permitted for persons with full legal capacity. When registering and booking, the person making the booking provides complete and correct information and protects their access data from unauthorized use. Use of the account by third parties is prohibited.
(2) Genobilia is entitled to carry out identity, creditworthiness and payment method checks as well as sanctions list checks. Booking requests may be rejected by Genobilia if checks fail, and bookings may be cancelled by Genobilia if checks fail.
(3) Genobilia may block accounts in the event of suspected fraud or significant payment arrears.
Section 3 No right of withdrawal for the person making the booking
For accommodation services offered or arranged via the website, there is no right of withdrawal under the statutory provisions (Section 312g (2) no. 9 German Civil Code (BGB)).
Section 4 Total price, due date, deposit, late payment
(1) Total prices consist of the overnight price, cleaning fees, service fees, deposit, and statutory charges (e.g., visitor’s tax). Unless stated otherwise, the total price is due upon booking.
(2) Deposits must be paid as stated. The deposit will be refunded within 10 business days after the accommodation has been properly returned.
(3) The person making the booking authorizes Genobilia to collect authorized payments as well as permissible additional charges (e.g., for culpably caused damage or for extraordinary final cleaning that became necessary due to significant soiling exceeding the usual level) via the payment method used. Such additional charges via the payment method used will only be made after prior notice to the person making the booking within 7 days after check-out, including reasons and evidence (photos or cost receipts).
(4) In the event of late payment, Genobilia or the Host is entitled to cancel bookings and refuse access to the accommodation.
Section 5 Check-in/Check-out
(1) The applicable check-in and check-out times can be found in the respective listing.
(2) A check-out after the check-out time (late check-out) may be charged at 20% of the daily rate.
(3) At check-in, a valid photo ID must be presented upon request; statutory registration forms must be completed in full and truthfully.
Section 6 Replacement accommodation
(1) In the case of Section 1 no. 2 a) of these GTC, Genobilia, and in the case of Section 1 no. 2 b) of these GTC, the Host, may provide equivalent or higher-value replacement accommodation in the event of material defects or overbooking. Criteria for equivalence or higher value include, for example, location, category, size, amenities, or accessibility. Any additional costs must be borne by Genobilia in the case of Section 1 no. 2 a), and by the Host in the case of Section 1 no. 2 b) of these GTC.
(2) Section 6 no. 1 of these GTC does not apply if using the replacement accommodation is unreasonable for the person making the booking or the guest. If the person making the booking or the guest refuses reasonable replacement accommodation, the person making the booking has no right to a refund.
Section 7 Use of the accommodation by the person making the booking or the guest
(1) Keys and other means of access must be kept safe by the person making the booking or the guest; in the event of loss, the resulting damage (e.g., replacement and lock change) will be reimbursed by the person making the booking. In any case, a flat fee of 20% of the daily rate will be charged if the key is lost. The person making the booking may provide evidence that no damage occurred or that it did not occur in this amount.
(2) The accommodation may be occupied by no more than the number of persons stated in the booking. If there is over-occupancy, Genobilia or the Host is entitled to withdraw. In the event of over-occupancy, Genobilia or the Host may charge the person making the booking a surcharge of EUR 25.00 per day for each additional person.
(3) Subletting or making the accommodation available for use to third parties is prohibited for the person making the booking or the guest.
(4) Smoking is prohibited in the accommodations. In the event of a breach of the smoking ban, a fee of EUR 150.00 will be charged. Smoke detectors in the accommodations must not be removed or disabled. In the event of a breach, a separate fee of EUR 150.00 will be charged.
(5) Defects must be reported immediately by the person making the booking or the guest. The statutory provisions (Section 536c BGB) apply.
(6) The person making the booking or the guest undertakes to use the internet access lawfully. Genobilia may block access if there is suspicion of legal violations.
Section 8 Cancellation, rebooking, no-show
(1) Unless otherwise agreed, the following cancellation conditions apply:
• Cancellation up to 30 days before arrival: refund of 100% of the total price minus the service fee
• Cancellation 29 to 15 days before arrival: refund of 10% of the total price minus the service fee
• Cancellation from 14 days before arrival or no-show: no refund
• Cancellation up to 30 days before arrival: refund of 100% of the total price minus the service fee
• Cancellation 29 to 15 days before arrival: refund of 10% of the total price minus the service fee
• Cancellation from 14 days before arrival or no-show: no refund
(2) The person making the booking may provide evidence that no damage resulted from the cancellation, or
not in the amount set out in Section 8 no. 1.
(3) Rebookings are possible depending on availability; any additional costs incurred must be borne by the person making the booking.
Section 9 Liability of Genobilia / Liability of the Host
(1) Genobilia/the Host is liable for its own intent and gross negligence as well as for intent and gross negligence of its legal representatives and vicarious agents. In the case of simple negligence by Genobilia/the Host, its legal representatives or vicarious agents, the liability of Genobilia/the Host is excluded. The exclusion of liability for simple negligence (Section 9 no. 1 sentence 2 of these GTC) does not apply to claims arising from injury to life, body, or health, and to claims arising from breach of essential contractual obligations (so-called cardinal obligations). Essential contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the contractual partner regularly relies and may rely. However, in the event of a breach of essential contractual obligations, the liability of Genobilia/the Host is limited to compensation for foreseeable damage that typically occurs. The exclusion of liability under Section 9 no. 1 does not apply to any claims due to warranted characteristics, claims under the Product Liability Act, claims based on a guarantee, or claims resulting from fraudulent concealment of a defect. Any further liability of Genobilia/the Host is excluded.
(2) If Genobilia acts only as an intermediary (Section 1 no. 2 b) of these GTC), it is only liable for the proper operation of the website and for its own obligations arising from the intermediary and payment services relationship. Genobilia assumes no liability for the condition, availability, promises, prices, or services of the Host. In these cases, claims of the person making the booking or the guest arising from the accommodation contract exist exclusively against the Host.

Insofar as booking processing depends on the availability of third-party technical interfaces (e.g., channel managers, external websites), Genobilia undertakes to remedy known disruptions with reasonable effort and to inform the person making the booking immediately of significant impairments.

Genobilia is not liable for failures or restrictions due to force majeure, official measures, power/network outages, strikes, or actions of third parties for which it is not responsible.
Section 10 Content, reviews, website use
(1) Content provided by the guest or the person making the booking (e.g., reviews) must be factual and lawful; in particular, unlawful, insulting, discriminatory, promotional, or third-party-rights-infringing content is prohibited.
(2) Genobilia may review, block, or remove content upon receiving notices of legal violations and take appropriate measures.
(3) Genobilia may moderate, edit, block, or delete content if it violates laws, third-party rights, or these General Terms and Conditions.
(4) The person making the booking or the guest grants Genobilia a non-exclusive, worldwide, perpetual, and free right to use publicly provided content (reviews, photos, texts) for display, reproduction, and distribution within the platform and its promotion.
(5) It is prohibited to initiate or conclude bookings or follow-up stays for accommodations advertised on the website by bypassing the website. Bypassing occurs if such a booking is concluded within 12 months after the initial listing-related contact between the person making the booking and the Host. In the event of a breach, the Host will be charged a contractual penalty of 12% of the total price of the respective booking. The right to claim further damages remains reserved.
Section 11 Data protection
The processing of personal data is governed by the privacy policy available on the website. It explains purposes, legal bases, recipients, and any transfers to third countries. The responsible entity for operating the website is Genobilia.
Section 12 Special provisions for worksite and long-term accommodations
If a legal entity or partnership acts as the person making the booking, it is jointly and severally liable for all fees, damages, and breaches of duty by the persons it assigns (guest).
Section 13 Contract administration, assignment, and changes
(1) Genobilia may amend these GTC with effect for the future. For bookings already made, the GTC in effect at the time of the booking request apply. Changes will be communicated to the person making the booking in good time. If the person making the booking does not object within three weeks and continues to use the website or makes a new booking, consent is deemed to have been given. The deemed consent under Section 13 no. 1 sentence 2 of these GTC does not apply to clauses that concern main services.
(2) Genobilia is entitled to transfer rights and obligations to affiliated companies; the person making the booking will be informed of this. Consumer rights remain unaffected.
(3) The person making the booking may only set off undisputed or legally established claims; rights of retention exist only with regard to claims arising from the same contractual relationship. Side agreements must be in text form.
Section 14 Final provisions
(1) German law applies; for consumers with their habitual residence in the EU, mandatory consumer protection provisions of their country of residence remain unaffected.
(2) For legal disputes between Genobilia and merchants or legal entities under public law, the exclusive place of jurisdiction is Cologne.
(3) The invalidity of individual provisions does not affect the validity of the remaining clauses.
